Terms of Use

These Terms of Use form a contract between you and Dayzeout Limited (trading as ChattyPatty). By creating an account or using ChattyPatty, you agree to these terms. If you do not agree, do not use the service. These terms apply globally, subject to any non-waivable local consumer rights.

  • ChattyPatty is provided for language learning and personal education; it does not provide legal, medical, financial, or other professional advice.
  • You must be at least 16 years old (or older where local law requires). If you are 16–17, you confirm you have appropriate parental permission where required.
  • You are responsible for the security and confidential use of your account credentials and devices.
  • Acceptable use: do not use ChattyPatty for unlawful, harmful, hateful, infringing, or abusive activities, and do not attempt to reverse engineer, overload, or disrupt the service.
  • AI & speech providers: some features rely on third-party AI and speech providers (currently OpenAI for text generation and ElevenLabs for speech synthesis). Your prompts, chat transcripts, and generated audio may be transmitted to those providers solely to fulfil your request. Outputs may be inaccurate or inappropriate; you should review them carefully before relying on them.
  • Third-party policies: you must comply with the usage rules of our providers, including OpenAI and ElevenLabs (e.g. no harassment, impersonation, or unlawful content), and platform rules (e.g. App Store/Play Store).
  • Intellectual property: we grant you a personal, non-transferable licence to use ChattyPatty. You retain rights in your own content; you grant us a limited licence to host and process that content to provide the service.
  • Service availability: we aim to keep ChattyPatty available but may suspend or modify features for maintenance, security, or legal reasons. We are not liable for indirect or consequential losses except where required by law.
  • Paid subscriptions are governed by our Subscription & Payment Terms below. Cancelling stops future renewals.
  • We may update the service or these terms with notice posted on this page or in-app.

Subscription & Payment Terms

ChattyPatty offers paid subscription plans that unlock premium learning features. These terms sit alongside our Terms of Use and reflect the requirements of UK consumer law (including the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015).

  • Who you contract with: subscriptions are provided by Dayzeout Limited (company number 15305920), registered at 124-128 City Road, London, England, EC1V 2NX.
  • Billing cycles and renewals: Paid plans are billed in advance, monthly or annually, in the currency shown at checkout. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • What you get: access to premium language-learning features, AI conversations, and content during your paid period, subject to fair use and provider availability.
  • Free trials: New subscribers can start a 7-day free trial by subscribing through the App Store, Google Play or chattypatty.io with a payment method. Nothing is charged during the trial. Unless you cancel at least 24 hours before the trial ends, the trial converts to the plan you chose and the first payment (the price shown when you subscribed) is taken. One free trial per person: Apple and Google decide eligibility on their stores, and on chattypatty.io a trial is available only if you have not subscribed with us before. If you are not eligible, the plan starts as a paid subscription, and the checkout shows the price before you confirm. Upgrading to a different plan during the trial ends the trial and starts paid access at once.
  • Who takes the payment: subscriptions bought on chattypatty.io are billed by Dayzeout Limited through Stripe; we never store your full card details on our servers, and receipts are sent to the email address on your account. App Store subscriptions are charged to your Apple ID by Apple, and Google Play subscriptions are charged to your Google Play account by Google, under their own terms.
  • Reminders: for a trial started on chattypatty.io, we email you 3 days before the trial ends with the amount you will be charged and how to cancel. For App Store and Google Play subscriptions, your trial end date and next renewal date are shown in your store's subscription settings.
  • Cooling-off rights: if you subscribe on chattypatty.io, you have 14 days from the start of your subscription to change your mind. You ask us to start providing the service straight away; if you cancel within those 14 days after being charged, we refund a proportionate amount for the unused part. When a free trial converts to a paid subscription, you have a further 14 days from the first payment to cancel and receive a proportionate refund. To use these cooling-off rights, email support@chattypatty.io within the 14 days from the email address on your account; we cancel the subscription and refund the unused part to your payment method. Cancelling at chattypatty.io/plan stops future charges but does not by itself issue a cooling-off refund. This does not affect your rights if the service is faulty. Cancellations and refunds for App Store and Google Play purchases are handled by Apple and Google under their own policies.
  • Refunds: apart from the cooling-off rights above, subscription fees are non-refundable once a billing period has started, except where a refund is required by law (for example, if the service is not as described or we fail to remedy a fault). Refunds for App Store and Google Play purchases are handled by Apple and Google; we cannot refund a store purchase directly.
  • Price changes: We may update subscription prices in the future. If we do, we will give you at least 30 days' notice so you can cancel before the new price takes effect.
  • Taxes & charges: Prices include applicable VAT unless stated otherwise. Your bank or card issuer may apply additional fees (for example, currency conversion) which we cannot control.
  • Cancelling: you can cancel at any time, in one step, where you subscribed. App Store: iPhone Settings › your name › Subscriptions › ChattyPatty › Cancel Subscription. Google Play: Play Store › your profile › Payments & subscriptions › Subscriptions › ChattyPatty › Cancel subscription. Web: chattypatty.io/plan › Cancel at renewal, or email support@chattypatty.io. Cancelling stops the next charge; you keep access until the end of the period you have paid for, or until the end of the trial if you cancel during it. To claim a cooling-off refund, see Cooling-off rights above. Deleting the app does not cancel a subscription.
  • Failed payments: we may suspend or downgrade access if payment fails and will attempt to notify you to update your payment method.
  • Referral rewards: if you share a referral code and a new user signs up with that code, a referral reward can be created when the referred user completes their first successful paid subscription invoice.
  • Reward type and value: referral rewards are issued as ChattyPatty subscription credits (not cash), and the standard reward is 70% of the referred user's selected plan monthly value at the time the qualifying invoice is processed.
  • Eligibility: referral rewards are intended for paid users and are unlockable on the Polyglot plan (for example, after annual Polyglot billing or after 3 successful monthly Polyglot payments). If a referral succeeds before eligibility is unlocked, we may hold it as pending and apply it once eligibility requirements are met.
  • Program limits: referral credits have no cash value, are non-transferable, and cannot be withdrawn to a bank account, card, or digital wallet.
  • Exclusions and abuse: self-referrals, duplicate or fake accounts, payment fraud, chargeback abuse, or other attempts to manipulate the program are not permitted. We may withhold, cancel, or reverse rewards where abuse is suspected or confirmed.
  • Adjustments and reversals: we may correct, delay, or reverse referral rewards if a qualifying payment is refunded, disputed, reversed, or later determined not to qualify under these terms.
  • Tax: because referral rewards are issued as subscription credits (not cash payouts), we generally do not collect payout tax information for this program. You remain responsible for your own personal tax position where required by law.
  • Program updates: we may change, pause, or end the referral program (including eligibility rules and reward values) where reasonably necessary for legal, fraud, operational, or product reasons.

If you believe a billing error has occurred, please contact billing@chattypatty.com within 30 days and we will investigate promptly.

Referral Rewards Summary

This section explains referral rewards in plain language. It is a summary for users and does not replace the full Terms of Use or Subscription & Payment Terms above.

  • Share your referral link from your ChattyPatty account.
  • A qualifying referral usually means: a new user signs up with your code and completes their first successful paid subscription invoice.
  • Rewards are applied as subscription credits toward future ChattyPatty bills and are not paid out as cash.
  • Standard reward amount is 70% of the referred user's monthly plan value.
  • Referral rewards are unlockable on the Polyglot plan once you are eligible (annual Polyglot billing, or after 3 successful monthly Polyglot payments).
  • If a referral succeeds before you are eligible, we still track it and apply the reward when you become eligible.
  • We email you when a successful referral is recorded.
  • We may delay, withhold, or reverse rewards if payments are refunded, disputed, reversed, or if abuse is detected.

Affiliate Program Terms

ChattyPatty may approve selected partners to promote the product through a separate affiliate program. These terms sit alongside the Subscription & Payment Terms above and apply only to approved affiliates.

  • Application and approval: affiliates must apply through the website and are not active until ChattyPatty has manually approved the application.
  • Shared signup code: approved affiliates receive a partner code that new users can enter in the same signup field used for referral codes.
  • Partner discount: where offered, the affiliate discount applies only to the referred user's first qualifying paid web upgrade and does not apply to App Store or Google Play purchases.
  • Default commercial terms: unless ChattyPatty agrees otherwise in writing, the default launch terms are a 15% discount for the referred user on the first qualifying paid web upgrade and affiliate commission calculated, before any affiliate discount, from our UK list price excluding tax or, if lower, our list price in the referred user's currency (converted to GBP at a published daily market exchange rate no more than two days old), rounded to the nearest penny, at 60% for month 1, 15% for months 2-12, and 5% for month 13 onward.
  • App Store and Google Play purchases: for a subscription the referred user buys in the iOS or Android app, commission is calculated on our UK list price or, if lower, the price the referred user paid in the app (converted to GBP at a published daily market exchange rate no more than two days old), in each case less the app store's 15% fee, at the same rates.
  • Minimum payout: we pay out once your cleared balance (commission past its hold period) reaches £25. A balance below £25 carries over to the next payout and is never forfeited, and ChattyPatty covers the transfer fees.
  • Hold period: qualifying commissions are normally held for 31 days from successful payment before becoming available for payout so we can process refunds, disputes, chargebacks, and fraud checks.
  • Reversals: we may reduce or reverse affiliate commission where the qualifying transaction is refunded, charged back, disputed, flagged for fraud, reversed, duplicated, self-referred, or otherwise ineligible. If that happens after the commission has been paid to you, the amount is deducted from your next payout.
  • Payout readiness: partner links, payout collection, and tax steps may be staged separately. ChattyPatty may delay payouts until all required onboarding information has been completed.
  • Brand use: affiliates must use ChattyPatty branding, screenshots, and claims accurately, include any legally required disclosures, and avoid misleading or deceptive marketing.
  • Suspension and termination: we may pause or terminate affiliate participation where abuse, non-disclosure, policy breaches, or operational risk are identified.

Privacy Policy

We collect the minimum data needed to deliver ChattyPatty and to keep your account secure. Dayzeout Limited (company number 15305920), registered at 124-128 City Road, London, England, EC1V 2NX, is the data controller for ChattyPatty (or the operator named in your app store listing). You can contact us at support@chattypatty.io.

  • Data we collect: account details (name, email, password hash), conversations and lesson content, learning preferences, support communications, limited payment metadata (via Stripe), usage analytics, and device information such as IP address and browser/app identifiers.
  • Diagnostics: we use Sentry to record app errors and crashes. In the mobile app, a sample of sessions (and sessions in which an error occurs) is also recorded as a screen replay so we can see and fix what went wrong. Replays mask what you are typing and all other on-screen text and images, including your name, email and prices, except the conversation itself: your messages and Patty's replies are visible in them. Replays are kept for up to 90 days and are used only to diagnose problems.
  • How and why: to provide and secure the service (contractual necessity), personalise learning content and improve quality (legitimate interests), send service messages (contract), and—only with your consent—send marketing updates which you can opt out of at any time.
  • Storage & retention: your data is stored securely in the EU/UK or other regions with comparable safeguards. We retain account data for as long as your account is active, support records for up to 2 years, analytics for shorter fixed periods, and logs for security for as short a period as practical. You can request deletion at any time.
  • Sharing: we only share data with trusted processors needed to operate ChattyPatty. This currently includes OpenAI (chat completions), ElevenLabs (text-to-speech), Stripe (payments), Sentry (error monitoring and, in the mobile app, sampled session replays in which everything except the conversation is masked), email delivery partners, analytics tools, and cloud/hosting providers. These partners receive only the data required to deliver their service and process it under data-protection terms. We never sell your personal data.
  • International transfers: where data is transferred outside the UK/EU, we rely on recognised safeguards such as Standard Contractual Clauses or equivalent protections offered by our providers.
  • Security: passwords are hashed, access is restricted, and we use encryption in transit. No system is perfect; if a personal data breach occurs, we will follow applicable notification rules.
  • Your controls: you can update your details, export transcripts (where available), or delete your account at any time from within ChattyPatty. (To do so, log in on the web version of the app, and navigate to the profile drop down where you'll see the "Delete Account" button). You can also opt out of marketing emails using unsubscribe links.
  • Complaints: if you have concerns, contact us first. You also have the right to complain to your local data protection authority, including the UK Information Commissioner's Office (ICO).

Cookies Policy

ChattyPatty uses cookies and similar technologies so the site remembers you and works properly.

  • Essential cookies: required for authentication, security, load balancing, and core features.
  • Analytics cookies: help us understand how ChattyPatty is used so we can improve the experience. Where required, we seek your consent before setting non-essential cookies.
  • Preference cookies: remember your settings (like language choices or theme).
  • Marketing/communication cookies: may be used if we run campaigns; you can opt out where applicable.

You can control cookies through your browser or device settings and withdraw consent for non-essential cookies at any time. Disabling essential cookies may break parts of ChattyPatty. Some providers (such as Google reCAPTCHA) may set their own cookies when they run within the product.

GDPR Policy

If you are located in the EU, UK, or another region with similar data-protection laws, you have specific rights under the GDPR/UK GDPR. We honour those rights globally.

  • The right to access copies of your personal data.
  • The right to correct inaccurate data.
  • The right to delete your data ("right to be forgotten").
  • The right to restrict or object to certain processing.
  • The right to data portability.
  • The right to withdraw consent where processing is based on consent.

To exercise any of these rights, contact us at support@chattypatty.io. We may need to verify your identity for your protection. We will respond within one month, or sooner where required by law. You can also lodge a complaint with the UK ICO or your local data protection authority.

We may revise these policies from time to time. If we make material changes, we will notify you via email or an in-app message and update the "Last updated" date below.
